You may think of divorce as beginning with Henry VIII. Actually, the practice goes back to ancient Greece where a magistrate determined if there was just cause. Divorces occurred in Roman times as well. Then, jolly Henry VIII split with the Roman Catholic Church in order to have his six wives, and the floodgates opened.

In fact, today some societies still do not allow divorce, including the Vatican, Malta, and the Philippines. However, reports say that 60% of people marrying for the first time in the United States will get a divorce. Finding 'fault' was the only way to break a marriage until recent times.

Now, forty-nine states of the U.S. have adopted no-fault divorce laws; only New York still requires a fault for the divorce. Many states now require mediation before a divorce will be considered; all states require a parenting plan if children are involved.

Whether divorce mediation services are ordered by the court or sought by one or both marriage partners, divorce mediators have special training and certification. Some lawyers are also trained as divorce mediators.
